Non-Disclosure and Goverance Code of Conduct - Privacy Policy

Please read the Terms and the privacy policy of the institute (privacy policy) carefully before using the website or services. In the event of any discrepancy between the Terms and any other policies with respect to the website orservices, the provisions of the Terms shall prevail. Your employment or use/career inquiry/browsing of the Website or the Services or registration through any means shall signify Your acceptance of the Terms and Your agreement to be legally bound by the same.

If You do not agree with the Terms or the Privacy Policy, please do not use the Website or apply. Any access to our institute premises, or website through inquiry or employment, if any, is non-transferable.

The candidate, if employed by Wissen Academy of Excellence, hereafter will be referred as candidate/prospective employee/party.

In Connection with the above, the Candidate Hereby Agree as Follows

  • “Confidential and or proprietary Information” shall mean and include any information disclosed by Wissen Academy to the employee either directly or indirectly, in writing, orally, by inspection of tangible objects (including, without limitation, documents, prototypes, samples, media, documentation, discs and code). Confidential information shall include, without limitation, any materials, trade secrets, network information including parent/student contact details, vendor details, configurations, trademarks, brand name, know-how,system passwords, login credentials, WiFi passwords, business and marketing plans, financials including fees structure and operational information, and all other non-public information, material or data relating to the current and/ or future business and operations of the Wissen Academy of Excellence and analysis, compilations, studies, study notes, summaries, extracts or other documentation prepared by the Wissen. Confidential Information may also include information disclosed to the Wissen Academy by third parties on behalf of the candidate, if employed.
  • The candidate, in case employed shall refrain from disclosing, reproducing, summarising and/or distributing Confidential Information and proprietary materials such as educational content/notes, timetable, reference notes designed and conceptualised by the Wissen Academy except in connection with the daily academic affairs.
  • Confidential Information shall at all times remain the property of the Wissen Academy and may not be copied or reproduced by the candidate, if employed, without the prior written consent of Wissen Academy management.
  • Within seven (7) days of a written request by the Wissen Academy, candidate, if employed, shall return (as may be requested in writing by Wissen Academy or upon service resignation and or earlier termination) all originals, copies, reproductions and summaries of Confidential Information provided to the Wissen Academy as Confidential Information. Wissen Academy shall certify to the candidate in writing that it has satisfied its obligations under this paragraph.
  • The candidate, in case employed may disclose the Confidential Information only to the Wissen Academy’s employees and consultants on a need-to-know basis only after receiving an appropriately written permission from Wissen Academy.
  • The candidate, in case employed will refrain from reaching out to parents and students directly on phone number, school or residential address or through email for any academic or non-academic purposes without getting a prior written permission from Wissen Academy. Employee will keep a safe distance from students by not linking on any of the social media platform and for the same it is expected and a must follow that employee does not share His/Her mobile number or social media handles with any student/parent in any circumstances. The candidate, if employed will not communicate for any sort of personal favour to parents/students/other employees of Wissen Academy. The employee will not provide counselling for any purpose other than the subjects, grades, and boards for which the employee is directly responsible for. In the event of employee observed deviating from the purpose, a strict disciplinary and legal action will be taken against the employee. All sort of communications/transactions with the employees if initiated by any student or parent must be brought to the attention of Wissen Academy management.
  • None of the candidate, in case employed will initiate, ratherrefrain himself/herself from establishing any sort of personal relationship with any academy student or employee during His/Her tenure with Wissen Academy. Failing to which and if observed, on such occurrence, employee will be terminated with immediate effect and panelised under Indian Pinal Code provision right at the first instance. The legal proceedings, if any will be carried within the jurisdiction of Pune Court in India.

Confidential Information, however, shall not include any information which the candidate can show:

  • is in or comes into the public domain otherwise
  • was already in its possession free of any such restriction prior to receipt from the employee;or
  • was independently developed by the employee without making use of the Confidential Information; or
  • has been approved for release or use (in either case without restriction) by written authorization of the Wissen Academy.

The candidate, in case employed shall not use the Wissen Academy’s name, trademarks, proprietary words or patent, or symbols or disclose under this undertaking in any publication, press release, marketing material, or otherwise without the prior written approval from Wissen Academy.

The candidate, in case employed agrees the conditions in this undertaking and the Confidential Information disclosed pursuant to this undertaking are of a special, unique, and extraordinary character and that an impending or existing violation of any provision of this undertaking would cause the Wissen Academy management irreparable injury for which it would have no adequate remedy at law and further agrees that the other party shall be entitled to obtain immediately injunctive relief prohibiting such violation, in addition to any other rights and remedies available to it at law or in equity.

The candidate, if employed will not have access to His/Her mobile phones or any connected/Bluetooth accessories while the classes are in progress. All study materials must be kept ready/prepared prior to conducting the actual classes pertaining to any specific topic. The candidate, hereby agree to follow this rule without any hesitation. However, the employee will be allowed to access the mobile phone in case of any special circumstances or medical conditions for a day or maximum two

The candidate, if employed shall indemnify the Wissen Academy and its directors, promoters, employees, students, and vendors for all costs, expenses or damages that Wissen Academy incurs as a result of any violation of any provisions under this undertaking. This obligation shall include court, litigation expenses, and actual, reasonable attorney’s fees.

Wissen Academy shall not be liable for any special, consequential, incidental or exemplary damages or loss (or any lost profits, savings or business opportunity) regardless of whether the candidate was advised of the possibility of the damage or loss asserted.

The candidate, in case employed agrees that this undertaking will be effective from the date of joining the Wissen Academy and shall continue to be effective till the Proposed Association is terminated by either Party by giving a thirty (30) days’ notice, in case either Party foresees that the Proposed Association would not be achieved.

The candidate, if employed agrees that He/She will provide a minimum of 30 days’ notice or till the session end period whichever comes later from the date of acceptance of resignation from the services of Wissen Academy. The employer reserves the right to keep and not pay the 30 days salary in an event of employee not serving the above said notice tenure. The said notice period recovery will be irrevocable under all circumstances. No personal, professional or health reason will be accepted from the employee for not serving the notice period. Wissen academy reserves the right of early reliving/accepting or modifying the notice period/wave off the notice period requirement at its discretion.

The candidate agrees that He/She will submit all requisite documents pertaining to the educational qualifications and professional experience in the past. The photocopy of all above mentioned certificates will be scrutinised and verified with originals by Wissen Management.

Employee (at candidature stage) shall submit documents relating to educational qualification (certificates pertaining to higher education, SSC, HSSC, Graduation, professional qualification), prior work experience, Government identification, authorised current and permanent address proof (Aadhar Card/Latest Electricity Bill/Registered Rent Agreement with owner’s latest electricity bill/Passport Copy) before joining.

The candidate agrees to submit His/Her anyone of the original SSC or HSSC board certificate and marksheet in Wissen Academy’s custody. In addition, management reserves the right to withhold 50% of the first month salary as a security deposit against notice period clause. This is to protect the academic interest of fellow students and is to avoid any sort of educational losses that may arise due to employee resigning in the midway of the session or without serving the notice period. Wissen management also ensures to return the original documents along with 50% first salary amount that was kept on hold (without any interest component) to employees immediately after serving the required notice period without any delay.

The candidate, in case employed warrants that it has the authority to enter into this Undertaking

This Undertaking shall be governed by the laws of India. Both parties irrevocably submit to the exclusive jurisdiction of the Courts in Pune, for any action or proceeding regarding this Undertaking. Any dispute or claim arising out of or in connection herewith, or the breach, termination or invalidity thereof, shall be settled by arbitration in accordance with the provisions of Procedure of the Indian Arbitration & Conciliation Act, 1996, including any amendments thereof. The arbitration tribunal shall be composed of a sole arbitrator, and such arbitrator shall be appointed mutually by the Parties. The place of arbitration shall be Pune, India and the arbitration proceedings shall take place in the English language.

Additional oral agreements do not exist. All modifications and amendments to this Undertaking terms and conditions must be made in writing as a part of joining formality, in case candidate gets shortlisted at Wissen

The Undertaking and/or any rights arising from it cannot be assigned or otherwise transferred either wholly or in part, without the written consent of Wissen Academy. Any violation by You of the terms of above Clauses may result in immediate suspension or termination of Your admission apart from any legal remedy that the Academy can avail. In such instances, academy may also disclose Your Admission Information if required by any Governmental or legal authority. You understand that the violation of these Terms could also result in civil or criminal liability under applicable laws.

Declaration by the Applicant

I have,

  • Read & understand the above and I am aware of the services WISSEN shall provide to the students.
  • Understood that the student’s performance depends on the continuing/participating interest on his/her part.
  • Aware that the conduct of Academic and Board exam is subject to Maharashtra State Board, CBSE & ICSE policies & regulations.
  • Declare and undertake that have read and understood the aforesaid “Student Guidelines” and will strictly adhere to the same at all times
  • I further agree that I will fully comply with all decisions made by WISSEN COACHING & comply with all decisions made by Wissen Academy of Excellence with regards to the above procedures and understand that the same will not be subject to any review under any circumstances.
